Scope of this policy

This policy describes how SPEKTRUM Sp. z o.o., which is the operator of the website, collects, uses or otherwise processes personal data of a given person in the context of using the website www.spektrum.wroc.pl and medical services provided by the operator (hereinafter the “Service”).

This policy includes a description of your data protection rights, including the right to object to certain processing activities that we carry out.

We will process your personal data as the data controller.

For the purposes of this Policy, the following term “Data Protection Legislation” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), as well as any legislation and/or regulations implementing or created on the basis of the provisions of the GDPR and on-line privacy legislation, and any other applicable national legislation concerning the processing of personal data and privacy, in particular the Act of 10 May 2018 on the Protection of Personal Data (Journal of Laws 2019, item 1781, as amended).

For the purposes of this policy, “data controller”, “processor”, “third party”, “supervisory authority”, “personal data”, “processing”, “data subject” have the meanings set out in the applicable data protection legislation.

How is user information collected by the Service?

The Service performs functions to obtain information about users and their behaviour in the following ways:

  1. By voluntarily entering information in the forms.
  2. By storing “cookie” files (so-called “cookies”) on terminal equipment.
  3. Through the collection of web server logs by the hosting provider.

How is the information provided in the contact form collected?

The Service collects information voluntarily provided by the user. In addition, the Service can save information about the connection parameters (time stamp, IP address).

The data provided in the form is not made available to third parties other than with the user’s consent. The data you provide is processed for the purpose resulting from the function of the contact form, i.e. to establish business contact.

The data provided in the forms may be automatically forwarded to entities that technically provide certain services – in particular, this applies to the forwarding of information about the holder of the registered domain to entities that are Internet domain operators or an entity that offers e-mail services.

For what purpose do we process your personal data?

The activities carried out are for the purposes of contact and the possible conclusion of a service contract, the preparation of information, certificates, medical records and accounting and tax operations. Data is stored with due care and in accordance with the security standards described in this Policy. We do not use personal data for marketing purposes unless with your separate consent.

Your personal data may be processed by the data controller for:

  • health prevention, medical diagnosis, treatment and provision of healthcare
  • medical record keeping
  • to ensure continuity of health services
  • performance of the service contract
  • resulting from the legitimate interests pursued by the data controller, e.g. for the purpose of contacting you to confirm, amend, cancel an appointment
  • marketing activities, if you have given your separate consent

On what legal basis do we process your personal data?

Your data is processed on the basis of Article 9(2)(h) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), which states that the processing of special categories of personal data concerning health is necessary for the purposes of preventive health care, medical diagnosis and the provision of health care.

In addition, the processing is based on the following provisions of the GDPR:

  1. Article 6(1)(a): the data subject has given consent to the processing of his or her personal data for one or more specific purposes.
  2. Article 6(1)(b):  processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
  3. Art. 6(1)(c): processing is necessary for compliance with a legal obligation to which the data controller is subject.
  4. Article 6(1)(d): processing is necessary in order to protect the vital interests of the data subject or of another natural person.

Who can receive your personal data?

Personal data entered into the contact form or sent directly to the email addresses provided on the website www.spektrum.wroc.pl are not transferred to third parties except as indicated in the Personal Data Security Policy, i.e. made available to government authorities or law enforcement officials if required by them and if so required by law, or to other entities if required to protect the legal interest of the data controller, only in cases provided for by law.

Is your data transferred outside the European Economic Area (EEA)?

We do not transfer personal data outside the European Economic Area.

Is your data used for direct marketing?

As a general rule, we do not use your personal data for direct marketing unless you have given your separate consent.

How long will your personal data be stored?

We will only retain your data for the period necessary to fulfil the purposes set out in this Privacy Policy, unless a longer retention period is required by law.

What are your rights?

Once you have provided personal data, you have rights under the provisions of the Data Protection Legislation which can be exercised free of charge, subject to statutory exceptions. In particular, you have the following rights:

  1. Right to withdraw consent: if your personal data is processed on the basis of your consent, you have the right to withdraw your consent at any time and on your own initiative. This can be done by any form, in particular by telephone 71 345 31 41, at the following e-mail address: biuro@spektrum.wroc.pl and by correspondence or in person at: ul. Zaolziańska 4, 53-334 Wrocław. The withdrawal of consent will not affect the lawfulness of the previous collection and processing of your data based on your consent until your consent is withdrawn.
  2. Right to access, view and correct your data: you have the right to access, view and request the correction of your personal data. You may ask us for a copy of your data to review or correct it; if you wish to review or correct any information such as your name, email address, postal address and other data, you may do so by contacting us by telephone at 71 345 31 41, by email at biuro@spektrum.wroc.pl and by post or in person at: ul. Zaolziańska 4, 53-334 Wrocław.
  3. Right to erasure: you have the right to request the erasure of all personal data processed as described herein when the personal data is no longer necessary for the purposes for which the personal data was originally collected or processed, in accordance with the Data Protection Legislation.
  4. Right to object or restrict processing: in certain circumstances described in the Data Protection Legislation, you may request the restriction of processing or object to the processing of your personal data.
  5. Right to data portability: you have the right to receive your personal data processed in a format that is structured, commonly used and machine-readable, and to transmit this data to another service provider.

These rights may be limited, for example, if complying with your request reveals personal information about another person or if you ask us to delete information that is legally required to be retained or necessary because of important legitimate interests.

If you have unresolved concerns, you have the right to lodge a complaint with the EU Data Protection Authority where you live, work or where you believe the breach may have occurred. What security measures have been put in place?

Appropriate technical and organisational measures are implemented to ensure an adequate level of security of personal data, in particular: personal data are stored only in IT systems protected against unauthorised access by third parties (computer running a full and secure version of the operating system, password protected, anti-virus and anti-malware software, automatic security updates, network protection by means of firewalls), and personal data recorded on paper are kept in locked office premises, to which access is restricted only to persons authorised by SPEKTRUM Sp. z o.o.

If personal data is compromised as a result of a security breach and if the breach is likely to result in a high risk to rights and freedoms, we will take the necessary notifications in accordance with the provisions of the Data Protection Legislation.

Amendments to this privacy policy

We reserve the right to modify and update this privacy policy. We will inform you about changes if they indicate a fundamental change in processing or are significant from the point of view of the nature of processing or are important to you and affect your rights to the protection of personal data.
